• Reference:

This regulation was drafted in compliance with one hand the specification of the delegation of public through the outsourced service for the management, operation and maintenance of the light equipment of recreational multi-site The Espace Portuaire de l'Uvarium in Moissac and on the other hand with the specification of the delegation of pathways waterways of France as well as port regulations in force on the day of writing.


• Definitions:

-Delegate: refers to the company of Ports and marinas (CEPP)
-The delegated agent: means any person mandated or used by the delegate to manage the port.
-Agent responsible for the port police: means any person entitled to enforce the administrative police (sworn employee of BNS, agents of the State, police, gendarmerie,...).


• Definition and allocation of the delegated zone:

The delegated zone includes:

-The lightweight recreational equipment (ELP) from port of Moissac with two banks for docking, a captaincy, sanitary facilities.
-Tarn ELP with two pontoons for docking.




Article 1 - Access to the port - maneuver within the port

1.1 - access to the port is allowed only to vessels able to navigate, i.e. in the State perform a navigation corresponding to the category, type and nature of the craft, except in cases of force majeure recognised by the delegate or its agents, provided that it is run no danger on the field conceded.


1.2 - the pilot of the boat must upon his arrival make themselves known to the delegated officers and meet the formalities for use (see articles 10 and 13).


1.3 - admission other than that of a pleasure boat cannot be done only in exceptional (refuelling or cases of force majeure accepted by the delegated officers) or shall be the subject of an agreement concluded between the delegate and the head of the concerned boat.


1.4 - the water update and draw grounded boats, on the places reserved for this purpose, are subject to the prior approval of the delegated officers and payment of the corresponding fee, for which a receipt will be issued.


1.5 - all other forms of water (craning,...) is subject to prior consent of the delegate or its agents.


1.6 - the delegated officers regulate the order entry and exit of vessels in the port. The crews of the vessels must comply with their orders and take of themselves, in the manoeuvres they perform, the measures necessary to prevent accidents.


1.7 - the maximum speed of the boats on the whole of the delegation is fixed at 3 miles per hour.


1.8 - except in the case of immediate danger, no anchor may be wet in the past, the front port and the port. Similarly, prohibited the mooring of mooring or piles.


1.9 - the manoeuvres in the port are limited to the only movements aiming to dock or leave the quays, pontoons and catways.


Article 2 - berth

2.1 - the mooring is strictly forbidden in the past of entry, with the exception of moorage to the home dock, and momentarily in exceptional cases accepted by the delegate.

The acquiescence of the owner or keeper of the vessel on which the mooring is to couple will be collected wherever possible. It is expressly forbidden in the tailbay.


2.3 - reservations for mooring can be taken to the extent possible, and will be saved from the receipt of the fee corresponding to the period desired (cf. articles 10 et seq.).


2.4 - in cases of absolute necessity, for technical reasons or safety:

-the delegated officers must be able, at any time, require the crew or the person must be designated by the owner of the boat, which must be able to perform all manoeuvres that him are ordered,

-in the case of absence of the owner, the delegated officers are qualified to perform or do carry out the manoeuvres needed, and without the responsibility of the owner is in no way clear.


2.5 - the owner, the crew or the guardian of a boat cannot refuse to receive a hawser, nor to unberth the vessel to facilitate the movements of other vessels.


Article 3 – Prevention and measures in case of fire

3.1 - it is forbidden to light fire on the pontoon boats and port facilities and have light to naked flame (except sites built for this purpose).


3.2 - light fixtures, heating vessels and their exhaust system, their electrical installations must comply with the regulations in force, under penalty of prohibition of use.
The connection on the network of the delegated zone must be in accordance with the provisions of this regulation. The delegated officers are responsible to ensure.


3.3 - the boats tied up should have on their board any dangerous substance or explosive other than fireworks or regulatory machinery and fuel or fuel required for their use. It is forbidden to smoke in the parts of the vessel containing flammable products.
These fuels or fuel-specific equipment or facilities must comply with the regulations in force for buildings depending on their category and their type.


3.4 - the owners of the boats are required to have on board the portable fire extinguishers conforming to the legislation in force.


3.5 - fire on the delegated domain, owners of vessels or their representatives are required to use their own fire extinguishers. They have at their disposal, in respect of the security, distributed fire extinguishers on the perimeter of the port (fire-fighting instructions are displayed outside the captaincy).
In addition, they must take all protective measures prescribed by the delegate or its agents and to comply strictly.


Article 4 – Work on vessels

No boat can be built or demolished on the domain of the delegation.


Inside the port and dependencies, the important work relating to the hull or requiring intervention on land must be made on the locations designated for that purpose (except cases of force majeure on the preservation of the integrity of the craft).


All bringing projections of products / materials hazardous work is absolutely forbidden.


Other work of repair and/or maintenance for the exterior and interior of the craft shall be carried out within the following time slices:

Monday to Friday 9 H 00 - 12 H 00 / 14 H 00 - 19 H 00
Saturday, Sunday and days holidays 10 h 00 - 12 h 00 / 15 h 00 - 18 H 00


Article 5 – Maintenance of boats

5.1 - all vessels staying in the port must be maintained in good condition, buoyancy and safety.

If the delegatee or its agents find that a vessel is in a State of abandonment, or in a State as it may leak or cause damage to vessels or surrounding structures, they put remains the owner, and at the same time, in an emergency, the person designated by the latter to proceed to reclamation or the putting out of water from the boat. If necessary has not been done within the time limit, it may be carried out putting out water from the boat, at the expense and risk of the owner.

In the event of non-manifestation of the owner of the vessel, the latter may be put out water at the cost and risk of the owner and without the responsibility of the delegate or that of its agents can be held liable.

5.2 - where a boat sank down in the port or in a navigable pass, the owner or the person designated by the latter is required to remove or move without delay, after taking advice from officials of the delegate on the execution mode of the manoeuvre.

In the event of failure of the owner, the staff take then all necessary measures to hasten the execution of operations, at the expense and risk of the owner.


Article 6 – Life on board

6.1 - it is subject to the control of the delegate or its agents given port capacity.


6.2 - to avoid the phenomena of overload of electrical power consumed during the winter period, the number of boats heated with electricity to be used as dwelling between October 15 and April 15 is limited subject to an increase in electrical facilities skills (technical requirements being 2.2 kw per post).

In the case of vessels in excess, the delegated officers reserve the right to allow the connection of electrical appliances on the network from the port. This measure is applicable only to vessels in excess.


6.3-mail addressed to vessels shall be kept at the captaincy of the port, for a period limited to one year, and placed at the disposal of the recipients without control or warranty of any kind, unless a duty of discretion elementary. Similarly, the existence of telephone messages will be displayed to the captaincy on an outer panel provided for this purpose.


6.4 - it is forbidden:
-to throw lands, rubble, garbage, sewage, bilge water, or unsanitary liquids on structures, in the waters of the Harbour and navigable passes,
-to make deposits. Household waste should be deposited in containers placed for this purpose on the delegated zone.


Article 7 – Circulation of vehicles

The movement of vehicles is prohibited on the towpaths.

The parking of vehicles is allowed only on the parking spaces reserved for this purpose, outside the port.
The port users have the possibility to use the reservation located along the north shore in Capestang on the opposite edge, outside the perimeter of the delegation, to park their vehicle, without so far having seats.

A single parking space included in the boundaries of the port in Capestang, is reserved for the delegated officers to guarantee them access to the site.
Security vehicles (ambulances, fire brigade, police) are exempt from any authorization.


Article 8 - Modification of structures - civil liability

8.1 - port users shall in no case modify the port facilities at their disposal.

They are responsible for the damage they cause to these works.
Damage are repaired at the expense of people who have caused them without prejudice to prosecution in practice against them, if applicable, in respect of the contravention.


8.2 - boat owners are responsible, without recourse against the delegatee, damage that, through neglect, clumsiness or non-compliance with this regulation, they cause to vessels or other users of the port facilities. Boat owners must have agreed, at least, a contract of insurance of civil liability for their boat and be able to justify to any request.

Port users who suffer damage to their vessels or installations of the fact of other users of the port, or people outside the port, make their case of the judicial measures that they are eventually brought to obtain compensation for the damage which is caused to them, without the intermediary of the delegate.


Article 9 - Sports

Activities animation and its benefits, and to any agreement with him, the delegate allows sporting practices resulting therefrom.


9.1 - the use of gears (pedalos, canoes, bikes... etc) is subject to those relating to the delegate:
-to the latter's agreement,
-to the prior payment of the tax rental and the filing of a deposit cheque,
-for the provision of a discharge of parents for minors unaccompanied,
-at the port of a lifejacket with regard to canoes and for all minors and persons not knowing swim,
-in respect of this regulation and the safety instructions given by the delegated officers.

As a general rule, and this applies to agreements with the delegatee, shall be prohibited:
-the practice of sailing and swimming in the waters of the port,
-the practice of high-speed human power (rowing, canoes, pedal boats...) in the port,


9.3 - the responsibility of the delegate could not be committed in the event of non-compliance with safety instructions listed in this regulation or handed over to users.


Children using leased equipment are under the responsibility of their parents.



(Less than 1 month unless special of the special police regulations)

Article 10 - formalities

10.1 - all vessels entering the area of the delegation to make stopover is required, upon his arrival, to the port office a statement of entry stating:
-the name, the characteristics, the Act of francization or the registration number of the vessel,
-the name and address of the owner,
-the name and address of the person responsible for the security in the absence of the crew, and the coordinates of the person mandated by the owner to represent,
-the certificate of insurance of the boat (civil liability to a minimum),
-the date scheduled for the start of the port.


If that date changes, a corrective statement must be made without delay to the captaincy of the port.


The parking fee will be paid upon entry in the delegated zone, with anticipation.


The boat must be submitted, the delegated officers, a declaration of departure during his final exit from the port.

Entry and departure statements are listed in the order of their presentation in a register where they receive a serial number.


The use of the services offered by the delegatee are subject:
-to a request for information on the uses with the delegated officers,
-to the prior payment of the corresponding fees,.
-on presentation of equipment and premises made available.

These services range from provision of:
-sanitary facilities (toilet),
-pedal boats, canoes, boats, bikes,
-post supply and electricity, water... and not are not closed.


Article 11 – Allocation of posts

11.1 – the location of the post that must occupy each boat is set by the delegate or its officers of the police of the port.
The allocation of positions shall be made, at the marked places, within the limit of available posts.
The delegate or its agents are, however, only judges of the circumstances which may lead them to derogate from this rule.


11.2 - the stay of the boats to stop is organized by the delegate or its agents, depending on available positions. Its duration is limited to 30 days (except special stipulation contained in the supplementary regulations of police) non-renewable. Beyond, berth will be awarded under Chapter III.

The user handling is required to change position if, for reasons of police or exploitation, this movement is directed by the delegate or its agents. He is required to leave the post occupied the first injunction of the agents of the delegate if, due to lack of space, the latter have made available a berth already awarded, but temporarily available.


11.3 - boats calling, outside opening hours of the captaincy, are required to Park primarily in the pontoon visitors, if places are available, excluding any other place.

Their owners must comply with the formalities laid down in article 10 as soon as possible.


Article 12 – Mooring at the wharf of home

The mooring is limited to the soft start time necessary to formalities for the home, to the water supply, diesel, for all buildings, boarding or disembarking of persons, for vessels for commercial use subject to an agreement with the delegate.


Beyond, a position of stop (under chapters II and III) will be awarded by the delegate.
Time slices can reserve the mooring priority to certain vessels of collective use, following the convention defined by the delegate.


These particulars will be posted to the captaincy of the port.

Article 13 - formalities

The formalities are the same as those of articles 10, 11 and 12 with the exception of the method of payment that will be made at the beginning of each monthly period of parking.


The duration of subscriptions is limited to one year. Subscriptions are certainly not renewable by tacit agreement. A new subscription may be established only after request of the owner of the vessel.


Article 14 – Taxes, uses, delay of payment

14.1 - the rates are reviewed annually on 1 January by the delegate.
These rates are those annexed to the present specification of delegation and will be posted at the port captaincy as from their implementation.


14.2 - any occupant shall pay his parking fee within fifteen days from the date of arrival of the invoice.


14.3 - the allocation of the substations will be registered and limited number of available positions. She investigated a meter rental fee.
It is forbidden to connect directly to the network of the delegate. Connections will be defined between the delegate and the user at the beginning of subscription.
The power consumption is charged in proportion to the energy consumed and increased the above rental fee.


14.4 - in the event of non-payment at maturity date of the amounts due and reminder of the delegate, the debtors are required to regularize their status with the delegate within fifteen days, otherwise to address a request to the delegate that may eventually propose a debt-rescheduling plan. Otherwise, discounts for long term parking will not be applied.
Beyond six months late, or in case of flagrant fraud, legal proceedings may be initiated with the assistance of the competent administrative authorities.


14.5 - all vessels must be in accordance with the legislation in force concerning him, in the navigation category.


Article 15 - Holiday - boat for sale

In the case of sale of a ship with a position in the port, the seller must make the declaration to the delegate from the completion of the sale.


In case of sale of a ship, concerned berth cannot, under any circumstances, be subject to a transfer of right.

The delegatee may eventually need to be assigned to the ship the transaction object, another post within the limit of available seats.


Article 16 - unemployment

The delegate accepts no liability due to unemployment and this incident during this time.
In this case, the delegate reserves the right to reassign the posts allocated on the basis of the requirements of safety. In particular, the keel boat docking will be considered a priority or planned for beaching boats in flat bottoms (dinghies, etc.).

Owners must comply with the indications of the agents of the delegate for the good implementation of these manoeuvres and cannot refuse the implementation of their instructions.

In the absence of the owner, or of its mandated representative the delegated officers must take all measures to carry out the operations necessary for maneuvers without their responsibility may be engaged.

The maneuvers carried out by the owners themselves, or their authorised representative, does not engage the delegatee, nor its agents.



Article 17 - Docks, medians, pontoons and catways

17.1 - the occupation of private title of the medians of the port is prohibited.
Any intervention implementing civil engineering works on the delegated zone is subject to written approval of the delegate.


17.2 - docks and channels within the scope of the delegation must permanently be left free to traffic. In any case, they cannot be cluttered deposits, equipment or materials of any kind whatsoever, except on the areas reserved for this effect or consent of the delegate.


17.3 - boats, to be put in the water or drawn ashore, on hold, or their annexes can stay on the medians of the delegation that the time required for these manoeuvres, unless prior authorization is given by the delegate.


17.4 - the use of pontoons and catways is strictly reserved to officers of the delegate, the owners and users of boats parked.
The delegate cannot be held responsible for incidents or accidents occurring on these facilities, other than those not covered by routine maintenance incumbent upon it.

17.5 - the responsibility of the delegate cannot be held liable because of the carelessness of any person found on the public domain granted and not entitled to circulate.



Article 18 - Implementation of regulation

The delegated officers are strictly required to implement the guidelines laid down in this regulation. They are also responsible for all measures concerning safety on the delegated zone.


Article 19 – Police and contraventions

Breaches of this regulation, the failure to comply, or all other offences concerning the police and the security of the port and its dependencies are discovered by a report drawn up by the port police officers who are authorized to take all necessary measures to put an end to the infringement.


Article 20 - responsibilities

20.1 - the owners of the boats remain civilly liable in all circumstances of tickets which may be their boats regardless of the people making use of these boats.


20.2 - the delegate cannot be held responsible for:
-any inconvenience or delays due to impediments or difficulties in navigation on the channel,
-any inconvenience or delays due to unemployment,
-flights and degradation committed on boats,
-damage or the gene causes due to navigation maintenance or, more generally, of the operation of the waterway by his Manager,
-of a loss of electrical power due to the breach of article 6.2,
-for fraudulent use of a socket by another user off normal surveillance of agents of the delegate, or in the case provided for in article 14.3,
-incidents or accidents referred to in article 17 paragraphs 4 and 5.


In particular, these shortcomings may give rise to the payment of compensation or reduction in invoice.


Article 21 - litigation

Disputes and attempt at amicable conciliation on the part of the delegate, the locally competent courts shall only empowered to judge the dispute.


Article 22 - Special provisions


Agents of waterways of France must be able to circulate freely on the slots occupied.
